Abstract: In the process of social transition, Russia has made the construction of a constitutional state a basic goal and direction for social development in the future. That is to say, the establishment of basic goal of Russia’s legal state and the transition of its social legal system are carried out under the large social background of Russia’s national modernization transformation. Since the 1950s-1960s, the Soviet Union and the Eastern Europe countries started the actual transformation from a traditional society to a modern society. In the initial stages of Russia’s social transition, the establishment of social legal system and theoretical system of law included both the criticism of legal institutions and juristal theory of the socialist Soviet Union and the transplantation and inheritance of the West legal theory and legal system, and a basic framework of legal modes and routes was formed in the seaselessly breaking and building legal institutions. At the same time, influenced by the factors such as traditional culture, national character and religious consciousness, Russia’s social transformation and social system had some natural endowments of a certain contradictoriness, fissility and complexity; Russia formed a unique legal development path.
